Privacy Policy
Industrial Color, Inc. (“IC”) is dedicated to protecting the privacy of your information
and provides this “Privacy Policy” to inform you as to, among other things, the
type of information that IC gathers from you on the IC [FileSociety] website (the
“Site”), how such information may be used or disclosed by IC to third parties, and
the efforts of IC to protect such information. Please read the Privacy Policy carefully.
This Privacy Policy is a part of the Terms of Use, which govern your use of the
Site.
Your access and use of the Site indicates your acceptance of this Privacy Policy
as part of the Terms of Use, which is a binding and enforceable contract between
you and IC. This Privacy Policy may be updated or modified from time to time at
the sole discretion of IC. Thus, we encourage you to review our Privacy Policy whenever
you use the Site to make sure you understand how your information will be used.
Your continued use of the Site following the posting of changes to the Privacy Policy
will signify your acceptance of the then current Privacy Policy. This Privacy Policy
will include the date IC last updated the Privacy Policy. If IC intends to disclose
information provided by you to third parties in a manner that is not already outlined
in this Privacy Policy, IC will so amend this Privacy Policy and will provide you
with an opportunity to opt out of any further use or disclosure of such information.
If you are a registered and licensed user of the FileSociety software system, then
your use of the same is governed by the terms and conditions of the ASP Agreement
entered into by you.
Information Collection
The Site does not track, collect, or distribute personal information about visitors
(such as name, address, email address, telephone number, or any other information
that might reasonably be used to identify visitors personally), except when specifically
and knowingly provided by you. In the latter case, subject to any applicable laws,
we may use your personal information to market products and services we believe
might be of interest to you.
IC may utilize software to collect and store various information about the usage
habits and activities of users of the Site. By way of example, IC may track the
number of people that visit certain pages on the Site or who use particular features
of the Site so as to better provide features and services to you. All such information
collected and stored will be used solely for IC’s internal business purposes.
In general, the Site gathers some generic information automatically. Generic information
is information that does NOT reveal your identity (“Non-Personally Identifiable
Information”). It includes, but is not limited to, information about the Internet
Protocol address assigned to your computer, the number and frequency of visitors
and the Web pages visited. This is accomplished by using certain technologies, including
“cookies.” Cookies are pieces of information transferred to your computer hard drive
for record-keeping purposes. The use of cookies is an industry standard and is used
by most major websites to provide the visitor with tailored information. You can
choose not to accept the cookie by adjusting your Internet browser settings but,
if you choose to do so, all parts of the Site might not function properly. IC will
only collect personally identifiable information, such as your name, address, email
address, telephone number, or any other information that might reasonably be used
to identify visitors personally (“Personally Identifiable Information”), when such
information is provided to us in an email, on a form, in online survey or in any
other manner when this information is intentionally transmitted to IC by you.
Disclosure
IC may share the Non-Personally Identifiable Information we collect with our affiliates,
contractors and other third parties. IC will not sell or distribute Personally Identifiable
Information to third parties. If you have voluntarily submitted Personally Identifiable
Information to us, IC will maintain the security of your Personally Identifiable
Information by ensuring the information is only distributed within IC. This enables
us to respond to your request about a product or service. If you subscribe to an
e-mail list, you will be given instructions on how to remove yourself from that
list. Within IC your Personally Identifiable Information will be transmitted and
stored in a protected environment. We undertake to take commercially reasonable
steps in order not to allow your Personally Identifiable Information to be seen
by any third parties other than those that have been engaged by IC to provide services
to IC or to you. We will only disclose your Personally Identifiable Information
to other third parties if compelled to do so for legal or regulatory purposes, and
you hereby agree to such disclosure.

This Site is not directed at children 13 years of age or younger. IC, therefore,
shall not intentionally collect information about any user under the age of 13.

The Site may provide links to other third party websites. Even if the third party
